Tuuci®, LLC (“Tuuci”, “us”, “we”, or “our”) operates the www.tuuci.com website (the “Service”). This page informs you of our policy regarding the collection, use, and disclosure of personal data when you use the Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible HERE.

What We Collect

We collect the below types of information for various purposes to provide and improve our Service to you.

Personal Data You Submit

We collect Personal Data when you submit it to us, such as when you purchase products or services; create a profile; take a survey; visit the Service; use an interactive feature; scan or use our QR codes; or contact customer service. The Personal Data you submit may include your name, postal address (including billing and shipping addresses), credit or debit card number, telephone number, mobile number, email address, gender, or username.

Personal Data We Receive from Third Parties

To the extent permitted by applicable law, we may receive Personal Data about you from third parties, such as social media services, commercially available sources, and business partners. The Personal Data we receive from third parties may include your name, contact information, information about your transactions, purchase history, or relationships with various product and service providers. For example, if you access the Service through a social media service or connect the Service to a social media service, the information we collect may also include your user ID and/or username associated with that social media service, any information or content the social media service will share with us, such as your profile picture, or email address. The information we obtain depends on your privacy settings on the applicable social media service. When you access the Service through social media services or when you connect the Service to social media services, you are authorizing TUUCI to collect, store, and use such information and content in accordance with this Privacy Policy.

Other Information

For purposes of this Privacy Policy “Other Information” is any information that is not intended to reveal your specific identity to us, such as browser information, usage data, information collected through cookies and other technologies, demographic information, geolocation data obtained with your consent where required by applicable law, and aggregated information.

Other Information You Submit

We collect Other Information when you submit it to us. This may include your password, birthday, occupation, or project types.

Other Information We Receive from Third Parties

We may receive Other Information about you from third parties, including, for example, demographic data, social media account number, information about your interests, and information about your activities on other websites.

Other Information Collected Automatically

The Service may also be linked to sites or apps operated by third parties, and may carry advertisements or offer content, special offers, functionality, games or applications developed and maintained by third parties, using iframes, tools, or plug-ins (“Linked Services”). These third party Linked Services may use automated means to collect information about you and your use of these features.

Tuuci is not responsible for the privacy practices of such third parties, and once you leave the Service or click an advertisement, or sign up for a special offer, you should check the applicable third-party privacy notice.

How We Use Your Personal Data and Other Information

We may use the Personal Data we collect from and about you for the purposes set forth below. We may use and disclose Other Information for any purpose, except if it is considered Personal Data under applicable law. If we combine Other Information with your Personal Data, we treat the combined information as Personal Data.

Through third party analytics providers, ad networks, and advertisers, we can track your online activities over time and across third party websites, apps and devices, by obtaining information through automated means.

This information, along with information we gather when you log in, can be used to understand use across sites and devices to help improve our products, remember your preferences, and show you advertisements on third party websites and apps that may be tailored to your individual interests. If you log in with or connect a social media service account with the Service, we may use Personal Data and Other Information to facilitate your sharing of information between the Service and your social media service. 

We may periodically send newsletters, marketing or promotional materials and other information that may be of interest to you, with your permission where required, surveys, market research, or notifications related to our products and services. To help make these materials more relevant to you, we may use and combine any of the Personal Data and Other Information we collect to assist us in sending you these materials. We may also use your information (including a telephone or mobile number you may have provided for this purpose) to contact you, including to respond to your comments, inquiries or requests. If you want to stop receiving these materials, please follow the unsubscribe link or instructions provided in any email we send or by contacting us.

How We Protect and Retain Data

We use a combination of administrative, technical, personnel and physical measures to safeguard Personal Data in its possession against accidental, unlawful or unauthorized loss, use, access, disclosure or modification. We make reasonable efforts to ensure a level of security appropriate to the risk of the processing, taking into account the costs of implementation and nature of the processing of Personal Data. However, no one can guarantee the complete safety of your information. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the instructions below.

We may retain Other Information for internal analysis purposes. Other Information is generally retained for a shorter time period than Personal Data, except when this data is used to strengthen the security or improve the functionality of the Service.

We will retain your Personal Data and Other Information for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or allowed by law.

Updates to Privacy Policy

We may periodically update this Privacy Policy without prior notice to reflect changes in our practices. Please look at the Effective Date at the top of this Privacy Policy to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Service. We will notify you by posting a prominent notice on the Service indicating we have updated this Privacy Policy. Your use of the Service or your provision of Personal Data to us following these changes means you acknowledge you have read and accept the revised Privacy Policy.

Do Not Track Disclosure

Some browsers or other tools include “Do Not Track” (DNT) features which, when turned on, send a signal to websites you visit indicating you do not wish to be tracked across websites over time. However, since no technology standard for DNT signals has been developed or adopted to date, the Service does not currently respond to DNT signals.

Transfers

Your Personal Data may be stored, transferred to, and processed in any country where we have facilities or in which we engage service providers. These countries may be outside your country of residence, including the United States, and may have different data protection laws than in your country.

If you are located in the European Economic Area or Switzerland (collectively, the “EEA”), we will implement appropriate safeguards to protect your Personal Data as required if we transfer it outside the EEA.

How We Share Your Personal Data and Other Information

There may be instances when TUUCI may disclose your Personal Data, including situations where we have a good faith belief that such disclosure is necessary in order to: protect, enforce, or defend the legal rights, privacy, safety, or property of TUUCI or our employees, agents and contractors (including enforcement of our agreements and our terms of use); protect the safety, privacy, and security of users of our products and services or members of the public; protect against fraud and other unlawful activity or for risk management purposes; comply with and enforce the law or legal process, including laws outside your country of residence, contractual obligations, and our policies; or respond to requests from public and government authorities, including public and government authorities outside your country of residence, to the extent permitted by applicable law.

How to Access, Correct or Update Your Personal Data

You can access, review, correct, update, delete or modify your registration or subscription profile information and modify your marketing preferences by contacting us below.

If you are in the EEA, you can also object to or restrict the processing of your Personal Data, or exercise your right to data portability. If you are in Nevada, you can also exercise your “Do Not Sell” right to opt out of interest-based advertising here or here. For your protection, we may only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions you began prior to requesting such change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Data provided until after the completion of such purchase or promotion).

Third Party Service Providers

We may make your Personal Data available to third party service providers, such as contractors or agents who help us manage or provide our products and services by, for example: developing or supporting products and features; sending email messages on our behalf; processing payments; fulfilling orders; delivering subscriptions; auditing; processing data or statistics; and serving, customizing or delivering marketing. These third party service providers are required to protect Personal Data entrusted to them and not use it for any other purpose than the specific service they are providing on our behalf.

Children’s Privacy

Our Service is not intended for anyone under the age of 18 (“Children”). No Children may provide any Personal Data and we do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

For California Residents

  1. California Shine the Light

Subject to certain limitations, California residents may ask us to provide them with a list of the types of personal data that Tuuci has disclosed to third parties for their direct marketing purposes during the past 12 months, and the identities of such third parties. To make such a request, California residents can write to us at info@tuuci.com, please us the subject line “Re: CA Shine the Light”, and include your name and the address to which you would like us to respond.

  1. California Privacy Rights

The California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA Regulations”), requires that we provide certain details about how we collect and use personal data, and give specific rights to California residents, which are detailed below. Where indicated, certain terms in this Privacy Policy have the meaning given to them in the CCPA or CPRA Regulations (hereinafter collectively “CPRA”).

  1. CPRA Privacy Rights

In addition to rights of access, correction, and deletion, as described above, California residents may have certain rights under the CPRA, many of which are subject to limitations or exceptions.

  1. Right to access/know and disclosure and portability

You may have the right to request, twice during a twelve (12) month period, the following information that we may have collected about you:

  • the categories and specific pieces of personal data we may have collected about you;
  • the categories of sources from which we collected the personal data;
  • the business or commercial purpose for which we collected or sold the personal data;
  • the categories of third parties with whom we shared the personal data;
  • the categories of personal data that we sold or disclosed for a business or commercial purpose,
  • the categories of third parties to whom we sold or disclosed personal data for a business or commercial purpose; and
  • the specific pieces of personal data we obtained from you in a format that is easily understandable.
  1. Right to nondiscrimination

We will not deny, charge different prices for, or provide a different level of quality of goods or services if you choose to exercise these rights.

  1. Right to opt out of the sale or sharing of your personal data

You have the right to opt out of the “sale” or “sharing” of your personal data with third parties who are not our service providers. California law broadly defines “sale” such that it may include allowing third parties to receive certain information, such as IP address and/or browsing behavior to deliver interest-based (also called targeted) advertising, or the sharing of a print mailing address with unaffiliated third-party companies whose products and services may be of interest to you.

We do not knowingly “sell” or “share” (as defined under the CPRA) the personal data of minors under 16 years old.

  1. Right to limit the use or disclosure of sensitive personal data

You may have the right to request that we limit the use or disclosure of your sensitive personal data (e.g., account numbers, racial or ethnic information) to uses necessary to provide the Service to you and for purposes permitted by applicable law (e.g., to ensure security and integrity).  Tuuci does not use sensitive personal data outside of these limited purposes.

  1. How to Exercise your California Privacy Rights

California residents may exercise the Right to Access/Know, Right to Correct or Right to Delete, and the right to opt out of the “sale” of personal data by submitting a request to us in a manner provided in the Contact Us section below.

Note, opting out of interest-based advertising is a device-based action because interest-based advertising is delivered using Cookies.  So you must use the adjust your Cookies settings, as described in our Cookie Policy.

California residents may also request that we limit the use or disclosure of their sensitive personal data by contacting us in a manner provided in the Contact Us section below.

For your protection, we will take steps to verify your identity before proceeding with your request as appropriate.

  1. Authorized Agents

You may designate an agent to exercise your rights under CPRA as described above. If you use an authorized agent, we will take steps both to verify the identity of the person seeking to exercise his or her privacy rights as listed above, and to verify that your agent has been authorized to make a request on your behalf through a signed written authorization or a power of attorney.

Once we have verified your identity (and your authorized agent, as applicable), we will respond to your privacy request as appropriate. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your privacy request. If we are unable to complete your privacy request in whole or in part, we will let you know why.

  1. Retention of Data

We may retain your personal data for as long as reasonably necessary to fulfill the purposes described in the Privacy Policy or as required by law.

For Virginia Residents

Virginia residents have certain rights in relation to their personal data, including the rights to request access to, correction or deletion of their personal data, to limit the use of sensitive personal data and to opt-out of the sale or sharing of personal data to a third party and/or the processing of personal data for the purposes of (i) targeted advertising and/or (ii) profiling.

Virginia residents may request to (i) opt-out of targeted advertising or (ii) limit the use or disclosure of their sensitive personal data by contacting us.

Virginia residents may exercise certain other rights with respect to their personal data by contacting us.

For Nevada Residents

If you are in Nevada, you may have the right to request that we do not “sell” (as defined under Nevada law) your personal data by contacting us.
